Immigration in 2021:
A Conversation With Forum
Chair Jurga McCluskey

Mobility: What are the top priorities for you
and the Immigration Forum in 2021?
Jurga McCluskey: The past year has been a

period of incredibly fast-paced change globally
in immigration policy, approach, and practice as
a result of COVID, Brexit, a new U.S. administration and Congress, and initiatives taken by
individual jurisdictions around the world. As
organizations begin looking toward recovery from
COVID, some of these changes have been and
could be unwound as there is a return to businessas-usual practices. However, other measures that
were implemented as a result of COVID and
worked really efficiently will likely become more
of a permanent fi xture in immigration policy and
practice. So, when you think about what the focus
is and what the top priority for 2021 may be, for
me it's about understanding the future of those
2020 immigration policies. How will they fare?
Which policies will remain, and which will be
eliminated? It's also important to consider how
efforts to recover from the pandemic will influence
immigration policy and process. There's a potential

for these recovery efforts to have an enormous
impact on immigration policy, so keeping the focus
on our goal of ensuring a reliable pro-business,
employment-based immigration policy will be a
top priority of our forum for 2021. This is supported by the principles for reform that Worldwide
ERCĀ® released last month.
Mobility: Speaking of COVID, what do you
see as the most significant impact of the
pandemic on the mobility industry?
McCluskey: 2020 was a truly unprecedented year

in so many respects, with travel and relocations
coming to a virtual standstill, many people
working from home, and many workers stranded
where they were located when borders closed.
How organizations work and the future of work
have fundamentally changed as a result of the
pandemic. Many businesses now understand that
working remotely can be done effectively and that
this doesn't always mean working from home in
the country you're based in. You can be working
remotely internationally, in another location,
provided that you have the right permission to
work in that location. Obviously, that depends
on your immigration status in that country. Th is
has also led to questions in terms of how global
mobility policy might be influenced: How would
the practices of global organizations change, and
how would their policies around how and where
employees work change? If organizations begin to
offer " work-from-anywhere, " it could potentially
have a tremendous long-term impact because so
many factors are involved. When a company is
considering whether someone is able to work from
anywhere, you're looking at what the implications
are for employment law, immigration law, tax,
