adequacy of an individual railroad's revenues each year. It also uses the figure
when determining the reasonableness
of a challenged rail rate, considering a
proposal to abandon a rail line, or valuing a particular railroad operation.
The STB's decision is contained in
Docket No. EP 558 - Sub-No. 19.
Referring to divergent comments
received related to the methodology,
the STB stated, "We have received comments from the Association of American
Railroads that provide the information
that is used in making the annual costof-capital determination, as established
in Use of a Multi-Stage Discounted Cash
Flow Model in Determining the Railroad
Industry's Cost of Capital - Use of MSDCF, EP 664 - Sub-No. 1, STB served Jan.

proposed changes to the bill of lading
that governs motor carriers.
The National Motor Freight Traffic
Association had proposed the changes,
and a three-member panel of the STB
ruled to allow them to take effect.
The Transportation Logistics Council
responded to docket ISM 35008 saying
new language would be detrimental to
shippers and would make it harder for
shippers to hold motor carriers liable
for damage during transport.
Specifically, TLC pointed to the old
language in the Uniform Bill of Lading
which stated, "The carrier or party in
possession of any property...shall be
liable..." The new language says, "The
carrier shown as transporting the property...shall be liable..."
The board did indicate that it will
consider comments on the matter,
to be filed by Sept. 12 and Oct. 3, to
determine whether to investigate the
issue further. An investigation by the
board has the potential of prompting a
modification to NMFTA's changes.
