The Region NEW HAMPSHIRE Whole Lotta Shakin' Goin' On Plenty of Legal Activity to be Aware of [by Gary M. Daddario, Esq., CCAL] Well, after what turned out to be a very brief lull in New Hampshire legislative activity, what followed was a flurry of proposed legislation that rivals the weekly blizzards we are getting at the time of this writing. This brief column does not allow for a detailed study, so what follows is a brief description of proposed legislation and the status of these bills as of mid-March. HB 519: Requires associations to use a tally sheet to count votes and to allow for an immediate recount upon request with witnesses observing 46 CONDOMEDIA the tally. This currently stands as an "ought to pass" measure. HB 1521: Requires both increased attendance requirements at budget meetings and a lower threshold for unit owners to reject the budget adopted by the board. It also defines an "emergency" for purposes of the applicable special assessment language in the statute. This is currently scheduled for further hearing. HB 1601: Clarifies the Condominium Act such that declarants would be limited in their development to the options which are (and have been) described in the statute. This currently has been referred to the Commerce Committee. SB 415: Allows unit owners in sufficient numbers to notice a special meeting of the association if the board fails to do so upon request. Also specifically allows for a vote at such meeting to remove one or more board members. This is currently being sent to the Commerce and Consumer Affairs Committee.
