make sure they review OEHHA's Prop 65 website page on petroleum, as the agency includes lubricants in the definition. The decades-old warning language for consumers - "This product contains a chemical known to the State of California to cause cancer [or reproductive harm]" - will change after Aug. 30. The new safe harbor warning language must include: * the word "WARNING" in all capital letters and bold print; * the phrase "this product can expose you ..."; * the name of one or more listed chemicals. If a warning is being provided for more than one endpoint (cancer and reproductive toxicity), then the warning must include the name of one or more chemicals for each endpoint; * a pictogram; and * the new Prop 65 URL (P65Warnings.ca.gov) run by OEHHA. Listing specific chemicals on warning labels will be an issue for manufacturers because OEHHA did not specify any criteria for deciding which chemical(s) to include on the warning. OEHHA has left it to the business to decide which and how many chemicals to list. OEHHA did make one exception to its requirement for chemical-specific warnings. For on-product warnings provided for consumer products, businesses may use a truncated safe harbor warning: * the word WARNING in all capital letters and bold print; * the word "cancer" and/or "reproductive harm"; * a pictogram; and * the Prop 65 URL. The required pictogram must be a symbol consisting of a black exclamation point in a yellow equilateral triangle with a bold black outline.
