normes est un classement des règles juridiques qui composent le système d'un État de droit en fonction de
l'autorité attachée à leur nature et ce pour en garantir la cohérence et la rigueur. Cette théorie est fondée sur
le postulat qu'une norme doit respecter celle du niveau supérieur et en constituer la mise en œuvre. Dans un
conflit de normes, elle permet de faire prévaloir la norme de niveau supérieur sur la norme qui lui est subordonnée. La norme inférieure ne peut alors ni abroger, ni déroger à une norme supérieure.
