Chapitre 1 * La prévoyance
L'état d'invalidité est apprécié en tenant compte de la capacité de travail restante,
l'état général, l'âge, les facultés physiques et mentales, les aptitudes et la formation professionnelle.
La sécurité sociale retient trois catégories d'invalidité déterminant le montant de la
pension (CSS, art. L. 341-4) :
- invalides capables d'exercer une activité rémunérée ;
- invalides absolument incapables d'exercer une profession quelconque ;
- invalides qui, étant absolument incapables d'exercer une profession, sont, en
outre, dans l'obligation d'avoir recours à l'assistance d'une tierce personne
pour effectuer les actes ordinaires de la vie.
Pension d'invalidité
1) Conditions
- être affilié à la sécurité sociale depuis au moins 12 mois à partir du 1er jour du mois
de l'arrêt de travail suivi de l'invalidité ou de la constatation de l'invalidité.
- remplir au moins une des conditions suivantes :
* soit avoir cotisé sur la base d'une rémunération au moins égale à 2 030 fois le Smic
horaire au cours des 12 mois civils précédant l'interruption de travail,
* soit avoir travaillé au moins 600 heures au cours des 12 mois précédant l'interruption de travail ou la constatation de l'état d'invalidité.
2) Montant
La pension d'invalidité est calculée à partir du salaire annuel moyen des 10 meilleures
années (dans la limite du plafond annuel de la sécurité sociale) en fonction d'un taux
variant selon la catégorie d'invalidité :
- 30 % pour les invalides de la 1re catégorie (CSS, art. R. 341-4) ;
- 50 % pour les invalides de la 2e catégorie (CSS, art. R. 341-5) ;
- 50 %, majoré de 40 %, pour les invalides de la 3e catégorie (CSS, art. R. 341-6).
B. Objet de la garantie
La garantie d'invalidité servie par le régime de prévoyance prend généralement
la forme d'une rente qui complète la très insuffisante pension d'invalidité versée
par la sécurité sociale (v. encadré). Elle peut aussi prendre en charge l'invalidité
consécutive à un accident du travail ou une maladie professionnelle en versant, là
encore, une rente complémentaire à celle de la sécurité sociale.
C. Conditions
Les contrats de prévoyance se réfèrent souvent à la définition légale de l'invalidité.
Mais le contrat de prévoyance peut, toutefois, retenir sa propre définition de l'invalidité, ce qui peut être source de complexité et de contentieux. Quoi qu'il en soit,
